Alstar Aussies and hereinafter known as the Breeder, in consideration of payment of ________and the agreement of __________hereinafter known as the Buyer, to abide by the terms of the agreement set forth below, the execution of which is acknowledged, hereby releases to the undersigned Buyer full responsibility and ownership subject to the reservation of rights set forth below for the Miniature Australian Shepherd dog described as:

• 1 Show/Breed Quality puppy back . Breeder will have the right to agree on which female's litter Breeder is to have choice puppy from. Breeder will pay all shipping costs to receive puppy to her residence.
Terms of the Agreement: I. THE BREEDER
A. The Breeder guarantees the Dog to be in good health when it leaves her kennel.
B. The Breeder guarantees this Dog to be free of inherited eye disease, hip dysplasia, elbow dysplasia, luxating patellas, thyroid dysfunction, and heart disease until the age of twenty six (26) months
C. Upon verification of hereditary problems in the Dog, this dog will be neutered and placed in a pet home, or if kept by buyer,Breeder will refund the portion of cost of puppy from show/breed quality to pet quality from this litter.
D. If the Buyer elects to keep the Dog, the Dog must be altered and proof of surgery sent to the Breeder within 30 days of confirmation of the problem
E. In the event that the Dog has a disqualifying fault according to the MACSA standard (not including height disqualification) undershot, overshot greater than 1/8 inch, un-descended testicle(s) - at the age of 12 months, the Buyer may choose to keep the Dog or to return the Dog to the Breeder. The Breeder must be notified of the Buyer's intent no later than the Dog's first birthday, and the terms of this guarantee must be carried out within 30 days of the Dog's first birthday. If a puppy has acquired a tempermant issue while in your care, and I am not notified before 6 Months, the above return policy would then be null and void, as far as any moneys being returned or a puppy replacement. In the case where your puppy is covered please send a corresponding veterinarian statement verifying the dogs conditions, temperments and any other pertinent information. I will always take my dogs back but each case will be separate and treated as separate issues. I DO have the final say on all cases.
F. If the Buyer elects to keep the Dog, the Dog must be spayed or castrated and proof of surgery sent to the Breeder. Upon verification of the surgery, the Breeder shall refund $200, bringing the price of the Dog down to the price of its non-breeding-potential littermates.
II. THE BUYER
A. The Buyer agrees to have the Dog examined, inoculated, and checked for internal parasites, including heartworm, annually by a licensed veterinarian. The Dog will be maintained on heartworm prevention as recommended for the area of residence, and will be treated as recommended by the vet and within reason for other problems. The Buyer will also strive to keep the Dog free of parasites throughout its life.
B. Showing: The Buyer agrees to attempt to complete at least one Championship or title by showing the Dog, or having it shown, a minimum of 10 shows between the ages of 12 and 36 months. The Dog is NOT guaranteed to finish a championship or any performance title in any registry.
C. Breeding: The Buyer agrees not to allow the Dog to be bred prior to two (2) years of age for females and two (2) year for males, nor before the Dog has been rated Good or better by OFA or ranked in the upper 50 percentile for the breed by PennHIP or cleared by the equivalent system, and clear within the prior year by CERF or a board certified veterinary ophthalmologist.
D. Name and Registration: The Breeder will send the Dog's registration forms for MASCA and NAMASCUSA to buyer within 60 days of purchase. The Dog's registered name will have "Alstar" as the first word. The Breeder will provide the Buyer with a copy of the Dog's individual registration application if available, a full description of the Dog at the time of sale, a pedigree of at least 3 generations.
E. Basic Care and Housing: To ensure the physical and emotional well-being of the Dog, the Buyer agrees to properly socialize the dog, and to provide him/her with companionship, food, water, medical care, training, and exercise appropriate to the age and condition of the Dog. The Buyer agrees to provide clean, dry, properly ventilated housing for the Dog. The Dog will not be left unattended on a chain, rope, or other tie-out device. The Dog will not be allowed to run loose unsupervised. Failure to comply with these requirements will void all guarantees in this contract.
F. By signing this contract, the Buyer represents and warrants that he/she does not breed nor provide dogs for sale or distribution through pet stores, animal dealers, or wholesalers, and does not engage in those or similar activities, and that no offspring produced by this Dog will be offered by the Buyer for sale through a pet store, animal dealer, or wholesaler. Sale of the Dog, or of offspring of the Dog, to or through such avenues will be damaging to the breed, the reputation of the Breeder, and potentially to the buyers of improperly bred and handled offspring of the Dog. Therefore, if the Dog or any of his/her offspring are so sold, traded, bartered, or given by the Buyer or his/her agent, the Buyer agrees to pay liquidated punitive damages of $1,000.00 to the Breeder and to turn the Dog over to the Breeder upon demand and without financial compensation, or, in the event that the Dog cannot be recovered, the Buyer agrees to pay $2,000 in liquidated damages to the Breeder for damages to the breed and the Breeder's reputation.
III. No Size Guarantee
A. Buyer understands that the miniature Australian shepherd is breed down from AKC—ASCA Australian Shepherd bloodlines and some of the puppies from this litter may fall in the AKC-ASCA height range as adults.
B. Buyer understands that Breeder does not guarantee that said puppy will be Under 18 inches. (18 inches is the current maximum height for Miniature Australian shepherds)
C. Buyer understands that even though puppy may be oversized it still is considered a Miniature Australian Shepherd and can only be shown and registered in venues that accept miniatures.
IV: Both Parties
A. Venue: This agreement is mutually stipulated to have been entered into Knox, county, Illinois, regardless of the place where it is signed. The Buyer and the Breeder agree that the proper venue for any legal action taken to enforce the terms and conditions of this agreement shall be in the county of the Breeder's residence and that this agreement shall be interpreted in accordance with the laws of the State of Illinois. In the event that legal action is taken to enforce the terms of this agreement, the prevailing party shall be entitled to an award of attorney's fees and costs. This contract is binding in the State of Illinois and is nontransferable unless agreed by both parties.
B. Buyer and Breeder agree that this contract constitutes the full and complete agreement between them concerning this transaction.
